Wills & Estate Planning for the Redlands and Bay Islands - Protecting What Matters Most
Because the People You Love Deserve a Plan
If you’ve ever thought, “I really should sort out my Will” – and then life got in the way – you’re not alone. Most Australians put it off. But not having a Will, an Enduring Power of Attorney or an Advance Health Directive does not protect your family from hard decisions. It leaves those decisions to someone else, at the worst possible time.
At Canaipa Law, your local legal team, we help families and retirees get their affairs in order – simply, clearly and without the stress.
Your Will
Protects your assets, your family and your wishes after you are gone.
Your EPA
Protects your financial and legal affairs if you lose the capacity to make decisions.
Your AHD
Protects your healthcare wishes if you are unable to communicate them yourself.
Wills, EPA and AHD Explained
A properly drafted Will ensures:
• Your estate is settled faster and with less cost
• Family disputes are far less likely to arise
• Guardianship of minor children is clearly documented
• A trusted person is appointed as your Executor to carry out your wishes
• Your assets go to the people you choose
Whether you own a home on the islands, have superannuation, investments, or simply want to make sure your family is looked after – a Will is the foundation of any good estate plan.
An EPA appoints someone you trust (your attorney) to make financial or legal decisions on your behalf if you lose the ability to make decisions due to illness, injury, or mental/cognitive decline. Unlike a standard Power of Attorney, an EPA endures – meaning it remains valid even after you can no longer make decisions for yourself.
With an EPA in place, your chosen person can step in immediately and manage your affairs without delay.
An EPA can cover:
• Access to bank accounts and financial management
• Paying bills and managing property
• Making legal decisions on your behalf
• Managing investments or business interests
Choosing the right attorney – and getting the document drafted correctly – is critical. We'll walk you through every step.
An AHD allows you to document your wishes about medical treatment in advance – so that if you're ever in a situation where you can't communicate, such as when your life is ending, you have a brain injury which is not recoverable, or you are on a respirator, your doctors and loved ones know exactly what you want.
• Whether you consent to or refuse specific medical treatments
• Your wishes around life-sustaining treatment
• Preferences for palliative or end-of-life care
This isn't a morbid document – it's a compassionate one. It removes the burden from your family of having to make impossible decisions under pressure, and it ensures your values and wishes are respected.
• Your Will – protects your assets and your family after you're gone
• Your EPA – protects your finances and legal affairs if you lose capacity
• Your AHD – protects your healthcare wishes if you can't speak for yourself
Together, these three documents give you – and your family – genuine peace of mind.
• Retirees and seniors on the Bay Islands and throughout Redland City who want their affairs in order
• Families with young children who need to appoint guardians and protect their future
• Property owners who want to ensure their home passes to the right people
• Anyone who has experienced a health scare and realised how quickly things can change
• People who have recently married, divorced, or had children – life changes mean your Will may need updating
If you already have a Will but haven't looked at it in more than five years, it's worth a review. Outdated Wills can cause just as many problems as having none at all.
