Wills, EPA and AHD Explained

A Will is a legal document that sets out exactly what happens to your assets, your property, and your belongings after you pass away. Without one, Queensland's intestacy laws decide who gets what – and that outcome may not reflect your wishes at all, and can be extremely costly.

A properly drafted Will ensures:

• Guardianship of minor children is clearly documented
• A trusted person is appointed as your Executor to carry out your wishes

An Enduring Power of Attorney is one of the most important legal documents you can have – and one of the most overlooked.

An EPA appoints someone you trust (your attorney) to make financial or legal decisions on your behalf if you lose the ability to make decisions due to illness, injury, or mental/cognitive decline. Unlike a standard Power of Attorney, an EPA endures – meaning it remains valid even after you can no longer make decisions for yourself.
Imagine this: you suffer a stroke or are involved in a serious accident. Your bank accounts are frozen. Your mortgage goes unpaid. Your bills go unpaid. An AHD allows you to document your wishes about medical treatment in advance – so that if you're ever in a situation where you can't communicate, such as when your life is ending, you have a brain injury which is not recoverable, or you are on a respirator, your doctors and loved ones know exactly what you want.
